CNews ISLAMABAD: Chief Justice Mr. Justice Iftikhar Muhammad Chaudhry after review of the plea for formation of full court to hear petitions against approval of nomination papers of President Gen. Pervez Musharraf for presidential election, Wednesday ordered that 11-member bench headed by Justice Javed Iqbal would continue hearing of these petitions. The bench had earlier sent its recommendation for full court to the Chief Justice after a brief session during which Hamid Khan, counsel for Justice (Rtd) Wajihuddin Ahmed, A.K. Doggar and Dr. Farooq Hassan requested for constitution of full court. The Chief Justice decided that the 11-judge bench headed by Justice Javed Iqbal will resume the hearing on the petitions on Thursday. The CJ citing the reasons said according to judicial tradition he has decided not to sit in a bench hearing constitutional petitions against the President. Two judges had already refused to sit in the larger bench for the hearing of the case saying they had already given their decision on the matter. These judges are Justice Falak Sher and Justice Mian Shakirullah Jan. Justice Rana Bhagwandas is on ex-Pakistan leave while Justice Nasir-ul-Mulk is scheduled to go on leave from October 20 and proceed abroad. Justice Saiyed Saeed Ashhad is on medical leave.
