Musharraf to take oath under 1973 constitution: Qayyum
ISLAMABAD: Attorney General of Pakistan Malik Abdul Qayyum said Monday that President Pervez Musharraf will take oath for his next term as the president of Pakistan under 1973 constitution.To avert any potential constitutional crisis in the coming days after President Musharraf takes oath as new President, the judges of higher judiciary are likely to be sworn in under 1973 constitution once again.According to Geo News, Malik Abdul Qayyum said that 1973 constitution is the supreme law of land even today; the chief justice of the apex court administers oath to the president under this constitution, adding it makes no difference under which constitution the apex court chief justice took oath.The sources said judges were afforded no protection under PCO promulgated on November 3, 2007 and the status of the present judges will appear nothing more than legal complexity in the wake of the annulment of PCO.The sources said PCO promulgated in 2002 gave protection to the judges, therefore the judges had to face no problem regarding the legality of their status and they had not to take oath afresh.This time the judges including Supreme Court Chief Justice, Justice Abdul Hameed Dogar will take oath under 1973 constitution before Musharraf is sworn in as the president.According to AGP, President Musharraf contested the presidential election under the 1973 constitution and now he would take oath under the same constitution.
